1. Applicability

These terms apply to the use of the Swimmigo app and the website swimmigo.com, offered by Bobika (KVK 95172076). By using the app or the website, you agree to these terms.

Swim schools and instructors are additionally subject to the Terms for swim schools and instructors and the Data Processing Agreement.

2. License

You are granted a non-exclusive, non-transferable right to use the app for personal, non-commercial use. Business use by swim schools and instructors is subject to the terms for swim schools.

3. Subscriptions and payments

Swimmigo subscription (for instructors and swim schools)

• Swimmigo subscription: the subscription to use the app (student tracking, communication, marketing toolkit) is taken out via the Apple App Store or Google Play Store.
• Payment: in advance per period (monthly or yearly).
• Cancellation: at any time via your App Store or Play Store account settings.
• Renewal: subscriptions renew automatically unless you disable auto-renewal at least 24 hours before the end of the period.
• Right of withdrawal: digital content is subject to a limited right of withdrawal; refunds are handled by Apple or Google.

Lesson payments (payments from parents for swimming lessons)

• Lesson payments: swim schools and instructors can offer lesson packages and subscriptions through the app. Payment is processed via the swim school's payment environment, with Stripe as the payment provider.
• Swimmigo's role: Swimmigo facilitates the payment technology, but is not a party to the agreement between you and the swim school and never receives your card or bank details. Swimmigo only processes transaction data (amount, status, date) on the swim school's instructions.
• Refunds: the refund policy is determined by the swim school. Any fee is not refunded on a refund.

4. Liability

• Swimmigo is a tool for tracking and motivation. It is not a substitute for professional swimming lessons or supervision.
• Bobika is not liable for damages arising from the use of the app, unless due to intent or gross negligence.
• Swimming lessons: the swimming lessons are offered and delivered by the swim school or instructor, who is responsible for quality, delivery and the refund policy. Swimmigo does not provide swimming lessons itself.
• Safety: swimming involves risks. Always supervise children near water.

5. Your data and the GDPR

How we handle personal data is described in our Privacy Policy. When a swim school stops using Swimmigo, the link with your account is disconnected and the data we processed on that school's instructions are deleted, while your own account and your child's progress record are retained. 6. User Generated Content (UGC)

If you post content (photos, text):

• You guarantee you hold the rights (for example, a photo of your own child).
• We may remove inappropriate content and block users who breach these terms.
• We have zero tolerance for hateful, illegal or pornographic content.

7. Amendments

We may update these terms. Major changes will be notified within the app.

8. App Store and platform-specific terms

If you downloaded the app from the Apple App Store or Google Play Store, the following terms apply.

• Acknowledgement: these terms are between you and Bobika only, and not with Apple Inc. or Google LLC. Bobika is solely responsible for the app and its content.
• License: the licence granted to you is a limited, non-transferable licence to use the app on Apple-branded or Android devices you own or control, as permitted by the applicable store's usage rules.
• Maintenance and support: Bobika is solely responsible for maintenance and support of the app. Apple and Google have no such obligation.
• Warranty: Bobika is solely responsible for product warranties. If the app fails to conform to an applicable warranty, you may notify Apple or Google, who may refund the purchase price.
• Product claims: Bobika, not Apple or Google, is responsible for addressing claims relating to the app.
• Intellectual property: in the event of a third-party claim that the app infringes intellectual property rights, Bobika is solely responsible.
• Legal compliance: you represent that you are not located in a country subject to a U.S. government embargo and are not listed on any U.S. government list of prohibited or restricted parties.
• Third-party beneficiary: Apple and its subsidiaries are third-party beneficiaries of these terms.
